How InsuredSupport Works

If you are a client of a NADFS Member you qualify to apply for a special insurance program known as Contractual Liability Insurance Policy for Marital Settlement Agreements (aka “InsuredSupport”) that covers and pays the monthly child and spousal support payments as stated in your Marital Settlement Agreement (MSA) when the Paying Party becomes involuntarily unemployed.

NADFS is the National Association for Divorced Family Stabilization whose members are family law attorneys and divorce professionals aiding divorced families with legal, emotional, spiritual and financial assistance. Their mission is “Protecting Families When Life Changes.”

InsuredSupport Coverage Explained

InsuredSupport does not insure people. It ensures your Marital Settlement Agreement and certain performance obligations in it, specifically the payment of monthly child and spousal support when the Paying Party becomes involuntarily unemployed.

Coverage is triggered when the Paying Party receives their first unemployment check from the state. InsuredSupport steps in and makes the monthly support payment directly to the Receiving Party. This is private insurance — it never has to be repaid.

InsuredSupport is a NADFS group master policy, therefore you must be working with a NADFS member attorney or divorce professional to be eligible for InsuredSupport insurance coverage.

If you are already represented by a NADFS member you automatically qualify to apply for coverage.

If the attorney or professional you are working with is not a member of NADFS, you can refer them to NADFS.ORG and have them become a member online in less than 5 minutes.

If you are not currently represented by an attorney, or you are no longer working with the attorney who prepared your marital agreement, you can indicate that on the application form and we will refer you to a NADFS member in your area. You can engage a NADFS attorney remotely online or via teleconference, as the only requirement to receive the insurance is that a NADFS member attorney must prepare and add the InsuredSupport addendum to your agreement and have both parties sign it. This can all be done electronically.

InsuredSupport is Contractual Liability Insurance for Marital Settlement Agreements. It pays child and spousal support directly to the Receiving Party when the Paying Party becomes involuntarily unemployed. Coverage provides up to 6 months of payments per unemployment event. This is private insurance — payments never have to be repaid.

The Paying Party must have a Marital Settlement Agreement in a state where InsuredSupport is offered, with monthly support obligations between $400 and $9,000 per month. They must be a full-time W2 wage earner in a non-seasonal position. Self-employed individuals do not currently qualify.

All claim payments are made directly to the Receiving Party. The Paying Party does not receive the funds. This ensures that support continues uninterrupted during periods of involuntary unemployment, protecting the financial stability of the family.

Yes, InsuredSupport can be added to both new and existing Marital Settlement Agreements. If you are already divorced and have an existing MSA with support obligations, if your attorney is a NADFS member you can simply ask them to prepare the Addendum.

If your attorney is not a member and does not elect to become a member of NADFS, we can refer you to a NADFS member in your area who will assist in the process so you can be covered.

If you are represented by a NADFS divorce counselor for emotional, religious, educational, or financial support, then you can use your current attorney even if they are not a member of NADFS.
